Not the ex-owner's to sell...In Reply to: Late in Recording Trustee's Deed posted by JK on March 16, 2004 at 8:31 PM : Hello : A friend bouht a place at foreclosure in CA : He did not receive the Trustees Deed until 3 weeks after the sale and noticed that the former owner had done a Quit Claim to someone in between the time of the sale and now receiving the Trustees Deed. : What should he do since the Trustee's deed is outside the 15 day period? : Is the transfer from the former owner to the new person a valid transfer (it was done WITHOUT title/escrow).? : Thank you for your help! JK, The defaulting owner of the property lost title to the premises at the moment of the trustee’s sale. Thus the foreclosed owner couldn’t legally pass on any title to the foreclosed property to anyone after the sale event. The post sale title to the foreclosed property was in suspense for 3 weeks and was no one else’s to give to anyone, until the winning bidder finally perfected his title to the property when he recorded his trustee’s deed.
