Re: "THT" co-TrusteeIn Reply to: Re: posted by Lughead on February 09, 2004 at 2:43 PM Let us say that you are the unknown co-trustee, owner or beneficiary of an unrecorded THT declaration. All one would need to do in order to find out your identity is to file a suit to recover the real property against the THT,and all persons, entities known or unknown claiming any legal or equitable right, title, estate, lien or interest whether recorded or unrecorded in the real property. By now you are probably wondering, how is it possible to even serve any of the aforementioned in order to get the case before the court? Easy, once all of the normal and customary ways of properly serving a defendent have been exhausted to no avail, section 415.50 of the California Code of Civil Procedure affords the plaintiff grounds to properly serve the defendent by publication. If the unknown person or entity does not reveal his or her identity at this point, they lose the real property by default. So guess what..... they always show up to protect their interest.
