: Yes, because the bonding requirement is not possible to achieve. No one is offering such a bond. And they probably never will.

Thanks for the response. My followup is:
If such bonds are not being offered, why hasn't this section of the civil code been amended? Know of any discussion on this by legislators? Any one we could contact?
Until the bonds are offered or until the law is changed I guess you just have to weigh the risk on a deal by deal basis.
