Certainly rent will be collected throughout the months it takes to foreclose.

I'm not saying every judge will agree with me. But, I am saying I'm seeing the tides turn with the courts in California. It's a simple issue of proof. The courts were just agreeing with everything bank's counsel were saying. Now, they're starting to say, "hey, wait a minute. we don't allow this as proof in any other case."

That's a big problem for anyone foreclosing on a MERS deal.
