Holdover Tenant playing games

The fillable form "Agreement to vacate" doesn't say anything about waiving the 90 day notice for the holdover tenant. What if the tenant signs it for cash for key due in 45 days or so, and then changes his mind at the expiration and make you give him the 90 days notice from that time? that way he buys another 45 days on top of the 90 days? what if you give him the 90 day notice first and then sign the agreement? Thank you for your help !!
